Terms of Service
This translation is for reference only. If there is any difference in content, the Japanese version prevails.
These Terms of Service (the “Terms”) set out the conditions for using cheese (the “App”). By using the App, you are deemed to have agreed to these Terms.
Article 1 (Definitions)
- “The cheese team” means the cheese operating team that provides the App.
- “User” means anyone who uses the App.
- “Account” means the ID automatically issued by the App and the information linked to it.
- “Group” means a unit in which Users gather through an invite code or invite link.
- “Round” means a single session of play, from when a User in a Group puts out a challenge until it ends.
- “Clip” means a video or photo that a User shoots and sends with the App in response to a challenge.
- “Chat” means messages sent and received within the App among the participants of a Group, or between two Users.
- “Pack” means a set of challenges created by a User; published Packs can be viewed and searched by other Users.
- “Post” means any information a User sends to the App, including Clips, Chats, Packs, and display names.
Article 2 (Accounts)
- An Account is created automatically the first time the App is launched. No email address or password is registered. On first launch, Users are asked to enter their gender and date of birth. Please enter accurate information.
- Account credentials are stored on the User's device. To prepare for loss or reset of the device, Users shall issue a transfer code as needed and keep it secure.
- The cheese team is not responsible for any disadvantage resulting from disclosing a transfer code to a third party.
- If the credentials are lost and no transfer code has been issued, the cheese team cannot restore the Account.
- Users may delete their Account at any time through the App. Deleted Accounts and Clips cannot be restored.
Article 3 (Age)
The App is intended for people aged 13 and over. Minors must obtain the consent of a parent or guardian before using the App.
Article 4 (Groups and Clips)
- Clips are shown to Users who have joined the same Group. Anyone who knows the invite code can join a Group. Users are responsible for managing with whom they share the invite code.
- Users permit other Group members to view, play, and export compilations of the Clips they have shot, within the App.
- Copyright in a Clip belongs to the User who shot it. The cheese team stores, copies, and converts Clips to the extent necessary to provide and improve the App.
- When sending a Clip that shows other people, Users shall, at their own responsibility, take the necessary care, such as obtaining those people's consent.
- Group Chats are shown only to participants of the same Group, and one-on-one Chats only to the other party. The cheese team does not view the content of Chats, except as required by law and to the extent necessary to respond to reports under Article 6.
- When a Pack is published, its name, description, included challenges, and the creator's display name become viewable and searchable by all Users of the App. Users choose the visibility themselves when creating a Pack.
Article 5 (Prohibited conduct)
Users must not engage in the following conduct.
- Conduct that violates laws and regulations or public order and morals
- Conduct that infringes the rights of others (copyright, portrait rights, privacy, reputation, etc.)
- Sending content that is obscene, violent, discriminatory, or seriously offensive to others
- Persistent contact, threats, harassment, or stalking directed at a specific User
- Sending content related to the sexual exploitation of children, or content that encourages self-harm or suicide
- Repeatedly abusing the reporting system without legitimate reason
- Impersonating others, or attempting to wrongfully obtain another person's Account
- Creating Accounts in bulk, accessing the App with automated tools, or placing excessive load on the servers
- Analyzing, modifying, or reverse engineering the App, or redistributing it without permission from the cheese team
- Using the App for commercial advertising or solicitation
- Any other conduct the cheese team deems inappropriate
Article 6 (Reporting, blocking, and actions by the cheese team)
- Users can report Posts they believe violate these Terms to the cheese team from within the App. In Chat, long-press the other person's message, choose “Report”, and select a reason. The other person is not notified of the report.
- The cheese team reviews reported Posts, generally within 24 hours, and if it determines that they violate these Terms, takes the measures described below. The cheese team does not promise to respond individually to every report.
- Users can block other Users. Once a User is blocked, Chats with that person are no longer shown, that person's messages in Group Chats are also hidden, and notifications from them stop. The other person is not notified of the block. Blocking applies only to Chat; it does not restrict Group membership or the display of Clips.
- Blocks can be removed from “People” on the Account screen.
- If the cheese team determines that a User has violated, or may violate, these Terms, it may, without prior notice, take actions such as deleting Posts, removing the User from Groups, or suspending or deleting the Account.
- The cheese team is not obligated to disclose the reasons for such actions.
Article 7 (Changes, suspension, and termination of the service)
- The cheese team may change the content of the App, or suspend or end its provision, without notice to Users.
- The cheese team is not responsible for any damage arising when the App cannot be used due to maintenance, outages, network conditions, natural disasters, or other unavoidable reasons.
- If the App is to be discontinued, the cheese team will endeavor to announce it on this site and in the App with reasonable advance notice.
Article 8 (Disclaimer)
- The App is provided as is. The cheese team does not guarantee that the App is free of defects or interruptions, or that it is fit for any particular purpose.
- Disputes between Users, or between a User and a third party, shall be resolved between the parties concerned; the cheese team does not mediate them and is not responsible for any resulting damage. However, this does not apply to responses to reports under Article 6.
- Even where the cheese team is liable to a User for damages, except in cases of willful misconduct or gross negligence by the cheese team, such liability is limited to direct damages that would ordinarily arise and, if there are paid services, capped at the amount the User paid to the cheese team in the past 12 months.
Article 9 (Intellectual property)
Copyrights, trademarks, and other intellectual property rights relating to the App and this site belong to the cheese team or the rightful owners. Rights to Clips are as set out in Article 4.
Article 10 (Changes to the Terms)
The cheese team may change these Terms as necessary. The revised Terms take effect when posted on this site. Important changes will also be announced in the App. By using the App after a change, you are deemed to have agreed to the revised Terms.
Article 11 (Governing law and jurisdiction)
These Terms are governed by the laws of Japan. Any dispute relating to the App shall be subject to the exclusive agreed jurisdiction, in the first instance, of the court having jurisdiction over the location of the cheese team.
